1. Agreement to Terms
By engaging AI Influencer Agency for AI influencer creation services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
AI Influencer Agency provides AI influencer creation services including but not limited to: custom AI persona development, visual identity creation, content engine setup, multi-platform deployment, personality training, and growth optimization services.
3. Project Engagement
All projects begin with a discovery call to understand your requirements. Upon agreement:
- A detailed project proposal and timeline will be provided
- A deposit is required to commence work (typically 50%)
- You agree to provide necessary brand assets and information
- Regular check-ins and approval milestones will be scheduled
4. Payments and Pricing
By engaging our services, you agree to:
- Pay the agreed project fee according to the payment schedule
- Pay the deposit before work commences
- Pay the final balance upon project completion and before deliverable handover
- For ongoing managed services, pay monthly fees in advance
All prices are in USD unless otherwise stated. Custom quotes are valid for 30 days.
5. Ownership and Intellectual Property
Upon full payment: You receive complete ownership of all deliverables including:
- AI persona specifications and training data
- Visual assets and brand identity materials
- Content generation systems and templates
- Account access and credentials
- All intellectual property created for your project
Portfolio rights: We may request permission to feature your AI influencer in our portfolio. This is optional and can be declined.
6. Client Responsibilities
You agree to:
- Provide accurate brand information and requirements
- Respond to feedback requests within agreed timeframes
- Provide necessary approvals to keep the project on schedule
- Ensure you have rights to any materials you provide
- Use the AI influencer in compliance with platform terms of service
- Consider disclosure requirements for AI-generated content
7. Refunds and Cancellation
Before work commences: Full refund of deposit minus a 10% administrative fee.
During project: Payment is due for all completed milestones. Partial refunds may be considered on a case-by-case basis.
Managed services: You may cancel with 30 days notice. No refunds for partial months.
8. Revisions and Changes
Each project includes a defined number of revision rounds as specified in your proposal. Additional revisions or scope changes may incur extra fees and timeline adjustments.
9. Confidentiality
We treat all client information as confidential. We will not disclose your project details, business strategies, or proprietary information to third parties without your consent.
10. Disclaimer of Warranties
While we strive for excellence, we cannot guarantee specific engagement metrics, follower counts, or revenue outcomes. Results depend on many factors including market conditions, content strategy execution, and platform algorithms.
11. Limitation of Liability
To the maximum extent permitted by law, AI Influencer Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, reputation damage, or business interruption.
12. Platform Compliance
We build AI influencers to comply with platform terms of service. However, you are ultimately responsible for ensuring ongoing compliance. We recommend transparent disclosure of AI-generated content where required.
13. Changes to Terms
We reserve the right to modify these terms at any time. Changes will not affect ongoing contracted projects but will apply to new engagements.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AI Influencer Agency operates, without regard to conflict of law principles.
